Όροι Συμμετοχής στην Κλήρωση από την Προωθητική Ενέργεια

1. Η ανώνυμη εταιρεία με την επωνυμία “DAUFOOD GREECE ΜΟΝΟΠΡΟΣΩΠΗ ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑ”, η οποία εδρεύει στο ΒΙΟ.ΠΑ, Άνω Λιοσίων επί της Εβδόμης και Πεντηκοστής οδού, αριθμός 15, Τ.Κ. 13341 Αθήνα, με Αρ. Γ.Ε.ΜΗ: 084689402000 και ΑΦΜ 094458113 και είναι Master Franchisee της αλυσίδας με την επωνυμία Domino’s Pizza στην Ελλάδα (εφεξής η «Διοργανώτρια) διοργανώνει προωθητική ενέργεια με τίτλο “Giftcard by Coca-Cola”.
2. Σκοπός της Προωθητικής ενέργειας είναι η ανάδειξη μέσω κληρώσεως τυχερών νικητών, στους οποίους η Διοργανώτρια θα απονείμει τα δια του παρόντος υπό τον όρο 10 προβλεπόμενα δώρα.
3. Δικαίωμα Συμμετοχής στην Προωθητική Ενέργεια. Δικαίωμα συμμετοχής έχουν όλοι οι μόνιμοι κάτοικοι Ελλάδος, άνω των 18 ετών (εφεξής οι «Συμμετέχοντες»).
4. Αποκλεισμός Διαγωνιζομένων. Δεν έχουν δικαίωμα συμμετοχής οι εργαζόμενοι της Διοργανώτριας, οι εργαζόμενοι της DAUFOOD GREECE ΜΟΝΟΠΡΟΣΩΠΗ ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑ, οι εργαζόμενοι των συνδεδεμένων με αυτές εταιρειών και καταστημάτων, οι εργαζόμενοι των Καταστημάτων, καθώς και οι σύζυγοι και οι συγγενείς αυτών πρώτου και δευτέρου βαθμού.
5. Διάρκεια Προωθητικής Ενέργειας. Ως διάρκεια διεξαγωγής της Προωθητικής Ενέργειας ορίζονται οι ημέρες: 15/04 - 15/06/2021 και ώρα έως 17:00 (εφεξής η «Διάρκεια»).
6. Τρόπος Συμμετοχής στην Προωθητική Ενέργεια. Με την επιφύλαξη των όσων ορίζονται στους όρους 3 και 4 ανωτέρω, κατά το χρονικό διάστημα που ορίζεται παραπάνω, οποιοσδήποτε ενδιαφερόμενος μπορεί να συμμετάσχει στην Προωθητική Ενέργεια αγοράζοντας ένα από τα 2 “Deals” : το Double Saver Deal:2 Μεσαίες Classic πίτσες & 2 Coca-Cola 330ml για 12,95€ ή το Single Deal: 1 Mεγάλη πίτσα& 1 Coca-Cola 500ml για 9,95 ακολουθώντας την κατωτέρω διαδικασία: 1) Επισκέπτεται την Ιστοσελίδα www.dominos.gr ή την Εφαρμογή Domino’s Pizza Greece, 2) Επιλέγει το πεδίο «Giftcard”, 3)Επιλέγει ποιο από τα 2 Deals επιθυμεί να αγοράσει,4)Προβαίνει σε εγγραφή, εφόσον πρόκειται για νέο χρήστη, ή σε σύνδεση στον υπάρχοντα λογαριασμό του, εφόσον αυτός υπάρχει ή συνεχίζει ως επισκέπτης, 4) Καταχωρεί τα στοιχεία του παραλήπτη της δωροεπιταγής, 5) Προβαίνει στην αγορά. Εφόσον ολοκληρωθεί η παραπάνω διαδικασία με επιτυχία, ο ενδιαφερόμενος αυτόματα αποκτά δικαίωμα συμμετοχής στην κλήρωση. Κάθε ενδιαφερόμενος έχει το δικαίωμα πολλαπλών συμμετοχών, ωστόσο, έκαστος Συμμετέχων μπορεί να κερδίσει μόνο ένα δώρο.
7. H Διοργανώτρια έχει το δικαίωμα να επαληθεύσει την εγκυρότητα των συμμετοχών σύμφωνα με το παρόν και να αποκλείσει οποιονδήποτε Συμμετέχοντα επιχειρεί να παρέμβει παρανόμως στη διαδικασία συμμετοχής ή του οποίου η συμμετοχή δεν είναι σύμφωνη με τους παρόντες όρους. Επιπλέον, η Διοργανώτρια διατηρεί το δικαίωμα να ακυρώσει οποτεδήποτε τη συμμετοχή οποιουδήποτε Συμμετέχοντα στην Προωθητική Ενέργεια ή να του απαγορεύσει την περαιτέρω συμμετοχή, κατά την απόλυτη διακριτική της ευχέρεια, καθ’ οιονδήποτε χρόνο, ακόμη και άνευ προειδοποιήσεως, εφ’ όσον κρίνει ότι η συμμετοχή του έρχεται σε αντίθεση με διατάξεις του νόμου ή γίνεται κακόπιστα ή καταχρηστικά ή αντίθετα προς την καλή πίστη ή τα χρηστά και συναλλακτικά ήθη.
8. Όποιος δεν επιθυμεί να συμμετάσχει στην Προωθητική Ενέργεια για οποιοδήποτε λόγο, μπορεί να το δηλώσει τηλεφωνικά καθ’ όλη τη Διάρκεια της Προωθητικής Ενέργειας από Δευτέρα έως Παρασκευή (εκτός αργιών) και ώρες από 09.00 π.μ. μέχρι 17.00 μ.μ. στο τμήμα Marketing της εταιρείας DAUFOOD GREECE ΜΟΝΟΠΡΟΣΩΠΗ ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑ ΑE, στο τηλέφωνο επικοινωνίας 210 6962850.
9. Τρόπος Ανάδειξης Νικητών Προωθητικής Ενέργειας. Μετά το πέρας της διάρκειας της Προωθητικής Ενέργειας, και συγκεκριμένα στις 22/06/2021 και ώρα 14:00 θα διεξαχθεί ηλεκτρονική κλήρωση μέσω της ιστοσελίδας www.random.org για την ανάδειξη των νικητών της τελικής κλήρωσης. Η ηλεκτρονική κλήρωση θα πραγματοποιηθεί στα γραφεία της DAUFOOD GREECE ΜΟΝΟΠΡΟΣΩΠΗ ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑ (Κριμαίας 1 & Μεσογείων, Αθήνα), παρουσία δύο (2) εκπροσώπων της DAUFOOD GREECE ΜΟΝΟΠΡΟΣΩΠΗ ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑΣ.
10. Νικητές Προωθητικής Ενέργειας. Από την τελική κλήρωση θα αναδειχθούν δέκα (10) νικητές (εφεξής οι «Νικητές»).
11. Δώρα Προωθητικής Ενέργειας. Οι δέκα (10) νικητές θα κερδίσουν έκαστος από μια (1) δωροεπιταγή αξία 100€ από τα καταστήματα Public.
12. Οποιεσδήποτε αλλαγές απαιτηθούν από τους Νικητές στις παροχές που περιλαμβάνονται στο Δώρο θα επιβαρύνουν τους ίδιους.
13. Αναπληρωματικοί Νικητές. Από την ίδια ως άνω διαδικασία θα αναδειχθούν και τέσσερις (4) επιλαχόντες Νικητές (εφεξής οι «Αναπληρωματικοί»), οι οποίοι θα μπορέσουν να διεκδικήσουν το Δώρο με σειρά προτεραιότητας είτε σε περίπτωση μη έγκυρης συμμετοχής των Νικητών είτε σε περίπτωση που δεν καταστεί δυνατή η επικοινωνία με τους Νικητές, είτε σε περίπτωση που οι Νικητές αρνηθούν ή δεν παραλάβουν το Δώρο.
14. Ενημέρωση για την Κατακύρωση – Απόδοση των Δώρων. Οι Νικητές θα ειδοποιηθούν τηλεφωνικά εντός τριών (3) ημερών από την ημερομηνία διενέργειας της κλήρωσης στα στοιχεία επικοινωνίας που έχουν δηλώσει στην εταιρεία DAUFOOD GREECE ΜΟΝΟΠΡΟΣΩΠΗ ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑ κατά την υποβολή της συμμετοχής τους.
15. Στην περίπτωση που κάποιος από τους Νικητές δεν ανταποκριθεί για οποιοδήποτε λόγο για να αποδεχθεί και παραλάβει το Δώρο του, τότε το δώρο που του αναλογεί απόλλυται και ουδεμία αξίωση δύναται να προβληθεί έναντι της Διοργανώτριας. Αντίστοιχα, στην περίπτωση που οι Αναπληρωματικοί δεν ανταποκριθούν για οποιοδήποτε λόγο για να αποδεχθούν και να παραλάβουν τα Δώρα τους, τότε τα δώρα που τους αναλογούν απόλλυνται και ουδεμία αξίωση δύναται να προβληθεί έναντι της.
16. Τα Δώρα είναι προσωπικά, δεν μεταβιβάζονται, δεν ανταλλάσσονται με χρήματα ή άλλη υπηρεσία ή προϊόντα, δεν εκχωρούνται σε συγγενικά πρόσωπα ή τρίτους ούτε αντικαθίστανται ή εξαργυρώνονται. Μετά την ολοκλήρωση της Προωθητικής Ενέργειας και την ειδοποίηση των Νικητών, η Διοργανώτρια απαλλάσσεται από οποιαδήποτε ευθύνη ιδίως για τυχόν ελάττωμα του δώρου της Προωθητικής Ενέργειας ή/και για τυχόν βλάβη - ζημία για οποιονδήποτε λόγο από δώρο και την χρήση αυτού ή / και για πράξη, παράλειψη ή συμπεριφορά οποιασδήποτε από τις σχετιζόμενες με το δώρο εταιρείες.
17. Ευθύνη. Κατά την αξιοποίηση των Δώρων η Διοργανώτρια ενδέχεται να κάνει χρήση υπηρεσιών τρίτων. Η Διοργανώτρια δεν ευθύνεται για τυχόν κακή ή πλημμελή εκτέλεση των υπηρεσιών που θα παρασχεθούν από τρίτους, για οποιαδήποτε ζημία ή βλάβη τυχόν υποστεί οιοσδήποτε κάνει χρήση των Δώρων ή κατά την παροχή υπηρεσιών συνδεομένων οπωσδήποτε με τα ανωτέρω Δώρα, ούτε υπόσχονται ούτε εγγυώνται την εκτέλεση των συμβατικών ή άλλων υποχρεώσεων οποιουδήποτε τρίτου σε σχέση με τα εν λόγω Δώρα.
18. Η Διοργανώτρια δεν φέρει καμιά ευθύνη σχετική με καθυστερήσεις, αλλαγές, διακοπές, ματαιώσεις, αδυναμία απονομής του Δώρου εξαιτίας καιρικών ή άλλων συνθηκών που εμποδίζουν την απονομή ή την κάρπωση του Δώρου, ή άλλων πράξεων ή παραλείψεων, τα οποία τελούν εκτός του ελέγχου και της σφαίρας ευθύνης της Διοργανώτριας. Επιπλέον, η Διοργανώτρια δεν φέρει ευθύνη για την ποιότητα των υπηρεσιών και δεν υπόσχεται ούτε εγγυάται την τήρηση των συμβατικών ή άλλων υποχρεώσεων οποιουδήποτε τρίτου σε σχέση με το Δώρο.
19. Η συμμετοχή στην Προωθητική Ενέργεια καθώς και η συμμετοχή των Νικητών ή/και των Αναπληρωματικών στο ταξίδι ισοδυναμεί αυτομάτως με δήλωση απαλλαγής της Διοργανώτριας από πάσης ευθύνης συμπεριλαμβανομένης χωρίς κανένα περιορισμό ευθύνης για τυχόν ατύχημα, σωματική ή άλλη βλάβη. Διευκρινίζεται ότι η Διοργανώτρια πέραν των ρητά αναφερομένων στο παρόν, δεν καλύπτει καμία άλλη δαπάνη, που ενδεχομένως δημιουργηθεί στο πρόσωπο των Νικητών ή/και των Αναπληρωματικών κατά την παραλαβή και αξιοποίηση των Δώρων αλλά και στο πρόσωπο των Συμμετεχόντων κατά τη συμμετοχή τους στο Προωθητική Ενέργεια κατά τα ανωτέρω.
20. Η Διοργανώτρια δικαιούται να μεταβάλει τους όρους της Προωθητικής Ενέργειας ή να τον ανακαλέσει με ανακοίνωση στην Ιστοσελίδα το αργότερο δύο (2) ημέρες προ της κληρώσεως, δηλαδή κατά τρόπο παραπλήσιο με αυτόν της ανακοινώσεως της προκηρύξεως της Προωθητικής Ενέργειας. Διευκρινίζεται ρητά ότι μετά την λήξη της Διάρκειας της Προωθητικής Ενέργειας ή μετά την κατά παράταση ή συντόμευση της λήξης της Προωθητικής Ενέργειας, οι οποιεσδήποτε συμμετοχές, θεωρούνται αυτοδικαίως άκυρες, ουδέν επάγονται αποτέλεσμα, δεν δίνουν δικαίωμα συμμετοχής στην Προωθητική Ενέργεια που έχει λήξει, ούτε δεσμεύουν πλέον οιονδήποτε. Κάθε τέτοια τροποποίηση θα αναρτάται στην Ιστοσελίδα.
21. Όσον αφορά την κλήρωση, η Διοργανώτρια διατηρεί το δικαίωμα τροποποίησης της ημέρας και ώρας της κλήρωσης, ορίζοντας νέα ημερομηνία, η οποία θα ανακοινωθεί στην Ιστοσελίδα προς πληροφόρηση κάθε ενδιαφερόμενου.
22. Η Διοργανώτρια διατηρεί την ευχέρεια να ακυρώνει συμμετοχές εφόσον δεν πληρούν τους όρους του παρόντος. Οι Συμμετέχοντες οφείλουν να ενεργούν νόμιμα και μέσα στα πλαίσια των χρηστών και συναλλακτικών ηθών. Οποιαδήποτε ενέργεια ή συμπεριφορά κάποιου Συμμετέχοντος κριθεί (βάσει ενδείξεων) από την Διοργανώτρια παράνομη ή καταχρηστική ή αντισυμβατική (μη φέρουσες αυτές, ήτοι η Διοργανώτρια, το βάρος της αποδείξεως) τότε η Διοργανώτρια έχει το δικαίωμα να αποκλείσει το Συμμετέχοντα από την Προωθητική Ενέργεια, ακόμη και να ακυρώσει το Δώρο.
23. Με τη συμμετοχή τους στην Προωθητική Ενέργεια οι Συμμετέχοντες δηλώνουν ρητά και αποδέχονται μέσω συμπλήρωσης του ειδικού χωρίου στην Ιστοσελίδα www.dominos.gr και του αντίστοιχου χωρίου στην Εφαρμογή ότι η Διοργανώτρια έχει το δικαίωμα να εντάξει τα μη ευαίσθητα προσωπικά δεδομένα τους για την εξυπηρέτηση της διενέργειας της παρούσας Προωθητικής Ενέργειας σε Αρχείο Προσωπικών Δεδομένων, είτε η ίδια ως υπεύθυνος επεξεργασίας είτε μέσω οποιουδήποτε άλλου προσώπου διορίσει για τη διενέργεια της ως άνω επεξεργασίας κατ’ εντολή και για λογαριασμό της. Τα ανωτέρω δεδομένα δεν θα κοινοποιηθούν σε άλλα εκτός των ανωτέρω, νομικά ή φυσικά πρόσωπα. Η Διοργανώτρια δεσμεύεται να διατηρήσει τα δεδομένα των Συμμετεχόντων για το χρονικό διάστημα που είναι απολύτως απαραίτητο για την ορθή διαχείριση της Προωθητικής Ενέργειας στο οποίο έχουν συμμετάσχει.
24. Σε κάθε περίπτωση, τα προσωπικά στοιχεία των συμμετεχόντων θα τηρούνται σύμφωνα με το Ν. 4624/2019 (ΦΕΚ 137/Α/29-8-2019) και σύμφωνα με τις διατάξεις του Κανονισμού (ΕΕ) 2016/679 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 27ης Απριλίου 2016 για την προστασία των φυσικών προσώπων έναντι της επεξεργασίας των δεδομένων προσωπικού χαρακτήρα και για την ελεύθερη κυκλοφορία των δεδομένων αυτών και την κατάργηση της οδηγίας 95/46/ΕΚ (Γενικός Κανονισμός για την Προστασία Δεδομένων). Η Διοργανώτρια επίσης ενημερώνει ότι δεν θα πραγματοποιηθεί μεταφορά ή διαβίβαση δεδομένων προσωπικού χαρακτήρα σε χώρες εκτός του Ευρωπαϊκού Οικονομικού Χώρου.
25. Οι Συμμετέχοντες συναινούν στη δημοσιοποίηση των στοιχείων τους κατά την ανάρτηση των αποτελεσμάτων της Προωθητικής Ενέργειας στην Ιστοσελίδα (όπου συγκεκριμένα αναφέρονται Ονοματεπώνυμο και Νομός). Με την επιφύλαξη των όρων του παρόντος, στα πλαίσια της Προωθητικής Ενέργειας, η Διοργανώτρια θα τηρήσει αρχείο με τα προσωπικά δεδομένα του Νικητή ή/και Αναπληρωματικών που αναφέρονται ανωτέρω (όνομα χρήστη, τόπος-διεύθυνση κατοικίας, αριθμό τηλεφώνου), τα οποία θα αποτελέσουν αντικείμενο επεξεργασίας για λόγους που σχετίζονται με τη διενέργεια της Προωθητικής Ενέργειας.
26. Οι Συμμετέχοντες διατηρούν το δικαίωμα να ζητήσουν οποτεδήποτε και χωρίς επιβάρυνση την επιβεβαίωση, τροποποίηση ή διαγραφή των δεδομένων προσωπικού χαρακτήρα ή περιορισμό της επεξεργασίας τους ή το δικαίωμα αντίταξης στην επεξεργασία, καθώς και το δικαίωμα φορητότητας των δεδομένων που τηρούνται στο ανωτέρω Αρχείο επικοινωνώντας με την Διοργανώτρια στο email: info@dominos.gr ή dpo@dominos.gr & στο τηλέφωνο 210 6962800.
27. Δικαίωμα καταγγελίας στην Αρχή Προστασίας Δεδομένων Προσωπικού Χαρακτήρα. Μπορείτε ανά πάσα στιγμή να υποβάλλετε καταγγελία στην Αρχή Προστασίας Δεδομένων Προσωπικού Χαρακτήρα (www.dpa.gr) στην περίπτωση που η επεξεργασία των δεδομένων σας γίνεται κατά παράβαση των διατάξεων του Κανονισμού (ΕΕ) 2016/679 στην ακόλουθη διεύθυνση: complaints@dpa.gr
28. Οι Νικητές ή/και οι Αναπληρωματικοί συναινούν ανεπιφύλακτα στην εκ μέρους της Διοργανώτριας προβολή του γεγονότος και της εικόνας τους στα μαζικά μέσα ενημερώσεως, εφόσον το επιλέξει η Διοργανώτρια, άνευ οιασδήποτε αμοιβής πέραν του δώρου.
29. Η συμμετοχή στην Προωθητική Ενέργεια συνεπάγεται την πλήρη γνώση των αναλυτικών όρων συμμετοχής καθώς και συνιστά ανεπιφύλακτη αποδοχή τους.
30. Επιτροπή αποτελούμενη από εκπροσώπους της Διοργανώτριας θα είναι η αποκλειστικά υπεύθυνη και η μόνη αρμόδια για την επίλυση οποιουδήποτε προβλήματος προκύψει καθ’ όλη τη διάρκεια της Προωθητικής Ενέργειας.
31. Δικαιοδοσία και εφαρμοστέο δίκαιο. Οι παρόντες όροι συμμετοχής διέπονται από το ελληνικό δίκαιο. Αρμοδιότητα για την επίλυση οποιασδήποτε αξίωσης ή διαμάχης που μπορεί να προκύψει σχετικά με την εγκυρότητα, την ερμηνεία ή τη συμμόρφωση των παρόντων όρων έχουν τα δικαστήρια Αθηνών
